Privacy Policy

Effective date: October 14, 2026

Emerson Property Management Inc. ("Emerson," "we," "us") respects your privacy. This policy explains what personal information we collect, how we use and share it, and the choices you have. It applies to our website, emersonpropertymanagement.com, our online forms, our ads and lead forms on Facebook, Instagram, and other platforms, our email, phone, and text message communications, and the property management, leasing, and real estate brokerage services we provide.

1. Information we collect

Information you give us. When you request a rental analysis, download a guide, book a consultation, fill out a form on our site, or submit a lead form in one of our ads, we may collect your name, email address, phone number, property address, property details (such as type, size, condition, occupancy, and current rent), your goals for the property, and anything else you choose to share.

Information from clients, applicants, and residents. If you become a client, rental applicant, or resident, we collect information needed to provide our services. This may include your name, contact information, date of birth, government-issued identification number, income, employment, rental history, and bank account or payment information. We collect it through lease applications, property management and other real estate forms you complete, tax reporting forms, and consumer reports from consumer reporting agencies, which we obtain with your authorization under the Fair Credit Reporting Act.

Information collected automatically. When you visit our website, we and our partners collect information such as your IP address, browser and device type, pages viewed, time on site, and the page or ad that referred you. We collect this using cookies, pixels, and similar technologies (see Section 4).

Information from third parties. We may receive information about you from advertising platforms such as Meta when you submit a lead form, from real estate agents and other referral partners, and from public property records and rental data providers.

2. How we use your information

We use personal information to:

  • Respond to your inquiry and contact you about the property or service you asked about
  • Prepare rental analyses, pricing estimates, and service proposals
  • Provide property management, leasing, and real estate brokerage services
  • Send you updates, resources, and marketing about our services, which you can opt out of at any time
  • Measure and improve our website, ads, and communications
  • Comply with legal obligations, enforce our agreements, and prevent fraud

Prospective tenants. We use the information you provide mainly to obtain consumer reports and to run background and rental history checks. We may discuss information from your consumer report or application with the owner of the property you applied for. We may also report rental payment information to consumer reporting agencies.

Property owners. When we manage your property, we use your information to deliver management services, file required reports with government agencies (such as the IRS), set up ACH deposits, and for other purposes you authorize, such as setting up utilities.

Real estate clients. When we represent you as a buyer, seller, landlord, or tenant, we may share your information at your direction with service providers your transaction requires, such as mortgage lenders and title companies. If you are a prospective tenant we represent, we may share your information with landlords or their agents with your knowledge.

3. Facebook and Instagram lead forms

When you submit a lead form in one of our ads on Facebook or Instagram, Meta shares the information you entered with us. We use it only to respond to your request and to follow up about our services, as described in this policy. Meta's own handling of your information is governed by the Meta Privacy Policy.

4. Cookies, pixels, and advertising

We use cookies and similar technologies to operate our website, understand how visitors use it, and measure and improve our advertising. This includes the Meta Pixel and Meta Conversions API, which allow Meta to collect or receive information from our website (such as pages viewed and forms submitted) and use it to deliver, measure, and improve ads on Facebook, Instagram, and other sites. We may also use Google Analytics to understand how visitors use our website.

You can control how this information is used:

  • Adjust your ad settings in your Facebook or Instagram account under Ad Preferences
  • Opt out of interest-based ads from participating companies at YourAdChoices
  • Opt out of Google Analytics with the Google Analytics Opt-out Browser Add-on
  • Block or delete cookies in your browser settings. Some site features may not work properly if cookies are disabled.

Our website does not currently respond to browser "Do Not Track" signals.

5. How we share your information

We do not sell your personal information. We share it only as follows:

  • Service providers who help us run our business, such as website hosting, CRM, email, phone and text messaging, scheduling, accounting, payments, tenant screening, listing, and maintenance providers. They may use your information only to perform services for us.
  • Advertising and analytics partners, such as Meta, as described in Section 4.
  • Property owners, with whom we may discuss prospective tenant information as described in Sections 2 and 6.
  • Real estate professionals and partners, such as lenders, title companies, and other agents, when you ask us to connect you with them or when needed to complete a transaction you requested.
  • Legal and safety reasons, when required by law, subpoena, court order, or government investigation, or to protect the rights, property, or safety of Emerson, our clients, residents, or others.
  • Business transfers, if Emerson is involved in a merger, acquisition, or sale of assets.

6. Who can access information in our files

Access to personal information in our files is limited to Emerson staff and agents who need it to do their work, such as the agent or broker handling your transaction, asset managers, application processors, and administrative and accounting staff.

Property owners do not have access to our files. We may discuss a tenant's consumer report or application with the owner. We provide copies to the owner only with the tenant's consent, or if we stop managing the property and the owner asks us to send the files to the owner, the owner's attorney, or a new property manager.

Agents who work with us may be independent contractors and may keep their own transaction files. We require them to protect that information as described in this policy.

7. Text messages

If you opt in to text messages, we will text you about your inquiry and our services. Message frequency varies. Message and data rates may apply. Reply STOP to unsubscribe or HELP for help. Consent to receive texts is not a condition of any purchase or service.

We do not share or sell your mobile phone number or text messaging opt-in consent with third parties or affiliates for their marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties, except service providers that help us deliver our messages.

8. Email

You can unsubscribe from our marketing emails at any time using the link at the bottom of any email, and we honor unsubscribe requests promptly. Our marketing emails identify Emerson as the sender and include our mailing address. We may still send you messages about your account or services you've requested.

9. How long we keep your information

We keep personal information for as long as needed to provide our services, respond to your inquiry, and meet legal, accounting, and real estate recordkeeping requirements. When we no longer need it, we dispose of it securely by shredding paper records and permanently erasing or de-identifying electronic records.

10. How we protect your information

We use reasonable administrative, technical, and physical safeguards to protect personal information. Paper files are kept locked. Electronic records are password-protected and available only to authorized staff. Our website uses SSL encryption and is regularly scanned for vulnerabilities and malware. We do not permit employees or agents to make copies of consumer reports.

No method of transmission or storage is completely secure, so we cannot guarantee absolute security. If a data breach affects your personal information, we will notify you as required by law.

11. Correcting errors

If we report incorrect information to a consumer reporting agency, we will correct our records and ask the agency to correct its records promptly after we confirm the error. If our records incorrectly show that you issued a dishonored check, we will delete the record once we confirm the error or you provide a law enforcement report stating the check was not authorized.

12. Your choices and rights

You may ask us to access, correct, or delete the personal information we hold about you, to get a copy of it, or to stop using it for marketing. Depending on where you live, including Texas, you may have additional rights under state privacy law, including the right to appeal if we decline your request.

To make a request, email info@emersonpropertymanagement.com or call (832) 802-0848. We will verify your identity before responding and reply within 45 days. To appeal a decision, reply to our response with "Appeal" in the subject line. We will not discriminate against you for exercising your rights.
